222.01 EMERGENCY POWERS.
(a) Intent and Purpose of Section. It is the intent and
purpose of this section to authorize a proclamation of a
state of emergency, to prescribe the President's powers
and duties with respect thereto and to prescribe
penalties for violations of orders, rules and
regulations.
(b) Proclamation of State of Emergency; Designation of
Affected Area. During times of great public crisis when
the public health or safety is imperiled because of
disaster, rioting or other similar public catastrophe,
or where there is reasonable apprehension of danger to
the public health or safety there from, the Village
President may proclaim a state of emergency and
designate the area within the Village involved.
(c) Promulgation of Orders, Rules and Regulations.
Following such proclamation, the Village President may
promulgate such reasonable orders, rules and regulations
as he or she deems necessary to protect life and
property or to bring the emergency situation within the
affected area under control. Said orders, rules and
regulations may provide for the control of traffic; the
designation of specific zones within the area in which
the occupancy and use of buildings and egress and
ingress of persons and vehicles may be prohibited or
regulated; the control of places of amusement and
assembly and of persons on public streets and
thoroughfares; the establishment of a curfew; the
control of the sale, transportation and use of alcoholic
beverages and liquors; and the control of the sale,
carrying and use of firearms or other dangerous weapons,
ammunition, explosives and inflammable materials or
liquids deemed to be dangerous to the public safety. The
Village President may also issue other orders, rules and
regulations, without being limited by the foregoing.
(d) Effective Date of Orders, Rules and Regulations.
Such orders, rules and regulations shall be effective
from the date and in the manner therein prescribed and
shall be made public as provided therein. Such orders,
rules and regulations may be amended, modified or
rescinded in like manner from time to time by the
Village President during the pendency of the emergency,
but shall cease to be in effect upon declaration by the
Village President that the emergency no longer exists.
(e) Violation of Orders, Rules and Regulations. No
person shall violate or fail to comply with any order,
rule or regulation promulgated under authority of this
chapter.
(f) Absence of Village President. In the absence of the
Village President or in the event of his or her
disability, the Village President Pro Tem shall have the
power and authority herein given the Village President,
and if neither the Village President nor the Village
President Pro Tem is able or available to exercise such
power and authority, then the Village Council, either at
a regular or special meeting, shall have such power and
authority.
