678.01 OPEN BURNING.
(a) No person shall burn or cause
to be burned outside of an enclosed building any waste materials, refuse, paper,
other combustible debris or garbage, with the exception of leaves and branches
as described hereinafter, within the Village. The burning of leaves shall be
allowed within the Village if all of the following conditions are met:
(1) The burning of leaves, which
may also contain branches less than two and one-half inches in diameter and four
feet in length, must take place on private residential property under the
control of those conducting the fire, who shall be eighteen years of age and
older, which fire shall not be located on any Village roadway or in any Village
drainage ditch.
(2) A permit for any such fire must
be obtained in advance of such fire from the Police Department. Said permit
shall specify the date, the hours and the purpose of such fire and shall name
the supervising party who will be in charge of the fire. Said permit may be
denied or revoked if atmospheric conditions are deemed by the issuing agent to
be of such a nature as to cause the fire to be a potential danger to persons or
property within the Village.
(b) Aside from the burning of
leaves and branches described in subsection (a) hereof, the only other types of
fires which may be allowed within the Village are as follows:
(1) Bonfires and campfires which
are to be used in conjunction with civic, social or athletic events may be
allowed, upon the issuance of a permit for such fire as described in subsection
(a) hereof.
(2) Fires for food preparation on
private property utilized in conjunction with barbecue grills and cooking
receptacles are allowed within the Village without a permit.
